| Abstract: | Діюча нормативно-правова база з питань забезпечення національної безпеки дозволяє не лише побачити недоліки регулювання в цій сфері, але і визначити шляхи її подальшого вдосконалення. Відсутність понятійної чіткості неминуче спричинила появу найрізноманітніших трактувань відносно юридичної природи і суті не лише державної і національної безпеки, але і інших термінів, тісно з ними пов'язаних. Поза сумнівом, держава повинна своєчасно реагувати на події, що відбуваються на світовій арені, і бути здатним захистити інтереси свого населення. Ключове завдання державних інститутів зводиться до захисту цілісності державно-правового простору, який здатний забезпечити реалізацію життєво важливих потреб як усього суспільства, так і кожної особи окремо. В дослідженні є аналіз розвитку наукових і законодавчих підходів до понять державної і національної безпеки; визначення місця забезпечення національної безпеки на сучасному етапі розвитку суспільства. Методологічну основу дослідження склали загальнонаукові методи, такі як аналіз, синтез, історико-правовий, формально-логічний, порівняно-правовий. В результаті проведеного дослідження визначені пріоритетні напрями розвитку держави. Зроблений висновок про те, що нині назріла необхідність розробки нового механізму розмежування повноважень між органами державної влади в країні, забезпечення прав і свобод людини і громадянина, а також створення сприятливого соціально економічного середовища життєдіяльності суспільства і держави. |
| Description: | The current regulatory framework in the on national security issues allows us to see not only the shortcomings of regulation in this area, but also to identify ways to further improve it. The lack of conceptual clarity inevitably led to the emergence of a wide variety of interpretations regarding the legal nature and essence of not only state and national security, but also others closely related to them. Undoubtedly, the state must respond in a timely manner to events taking place on the world stage and be able to protect the interests of its population. National security can be really ensured only in a state governed by the rule of law, therefore, the key task of state institutions is to protect the integrity of the state and legal space, which is capable of ensuring the realization of vital needs of both the whole society and each individual individually. The purpose of the research is to analyze the development of scientific and legislative approaches to the concepts of state and national security; to determine the place of ensuring national security at the current stage of development of society. The methodological basis of the research was made up of general scientific and private scientific methods, such as analysis, synthesis, historical - legal, formal - logical, comparative - legal. As a result of the conducted research, the priority directions of the development of the state have been identified. Conclusions. The article concludes that there is currently a need to develop a new mechanism for the division of powers between public authorities in the country ensuring human and civil rights and freedoms, as well as creating a favorable socio - economic environment for society and the state. |
